WILLS, TRUSTS AND ESTATE MATTERS

The drafting of a Will is a serious matter designed to accomplish several objectives. The most obvious is the planned distribution of a person’s estate. Estate Tax consequences are a major consideration, as is the care of children or other relative or beneficiary who may be in need of a Guardian or Trustee.

After the death of a loved one, administrating a Will may be the last thing on your mind. Nonetheless, it is important to begin the process of organizing the financial affairs of the decedent and determining his or her wishes with regard to property distribution. Estate administration is the process of probating the estate of a decedent, which generally includes collecting, inventorying and appraising assets; paying and collecting debts; filing and paying estate taxes; and distributing any remaining assets to beneficiaries. Our experience in probate and estate administration can help simplify this complicated process.

Whether or not the decedent had a Will, the person's estate must be settled through the probate court. Probate is a proceeding brought to approve a Will, and appoint the executors to execute the provisions of the Will.  While a Will may nominate executors, the executors do not have any official power until their appointment is confirmed by the court. It is always possible that an heir, more formally known as a distributee, could contest the probate of the Will. Our attorneys guide our clients throughout the entire process.
